Dealing with the Papers

What are we to do when media outlets knowingly and willfully divulge classified information that is critical to our winning a world war? Self-serving media bureaucrats like the New York Times’s Bill Keller can wrap themselves in the First Amendment, but these are the same people who editorialized about the limits of political speech which is covered by that same amendment (and political speech, as opposed to, say, pornography, was the kind of speech the framers were most concerned about protecting).

Moreover, these media outlets are hostile to judicial nominees who embrace originalism, preferring activists who view the Constitution as “living and breathing” — except, of course, when it comes to a free press. Then they demand a strict constructionist approach in which the words of the First Amendment are applied literally. But even under an originalist analysis, which I won’t do here, speech was not considered a boundless right. And that’s especially the case where the very survival of the country, in the midst of a war, is at stake. Meanwhile, the Supreme Court has been all over the map in trying to define the limits of speech, e.g., flag-burning is covered, cross-burning is not covered, and so forth. (more…)

Our courageous fellow Americans in the military, intelligence agencies, and law enforcement work day and night to stay one step ahead of the next planned attack on our cities by trying to track terrorist communications, contacts, and financial transactions, and many in the media see their goal as exposing these secret efforts.

The media claim to be representing “the public interest.” But that’s not a defense to willful, serial criminal activity. I suppose the moles in our government who leak the information to the likes of the New York Times can claim the same thing. Indeed, Bill Keller said as much when he wrote that some officials question the legality of the financial-tracking system. Who cares if they violate not only the law, put their sworn oath to uphold the law and the trust of their colleagues and fellow citizens. And the mere assertion by Keller that his lawlessness is in the public interest doesn’t make it so. This is a self-serving claim and nothing more. (more…)

Neil Cavuto on FOX made a great point last evening when interviewing billionaire Mort Zuckerman. They were talking about Warren Buffett’s decision to donate $37 billion of his over $40 billion fortune to the Gates Foundation and Cavuto noted that Buffett could have given his money to the government instead. The point is that Gates, Buffett, Zuckerman, and many other super-rich, left-leaning philanthropists favor the death tax. They can give all their money to the government now, or upon their death. Instead, they set-up these charitable foundations (or support them) which allow them to direct how their money is spent. I don’t begrudge them at all. It’s their money and they can do whatever they want with it. But I do think it’s worth noting, as Cavuto implied, that their support for the death tax only goes so far. In fact, by donating stock to the Gates Foundation, to the best of my knowledge there is no taxable event to Buffett.

Last night Andrew Wilkow payed us a nice compliment during the show.

Andrew can currently be heard on WABC radio on Sunday Morning from 10:00AM to 1:00PM.

He also has a weekday program that airs on 810 WGY in Albany, NY. Andrew’s final show on WGY will air July 14th, before he starts a new show for Sirius Satellite Radio.

Will create new style of conservative talk on SIRIUS Patriot channel

Wilkow’s show will air on SIRIUS Patriot, channel 144, weekdays from 12 to 3 pm ET, starting on August 1.

I remember listening to Andrew on Radio 104 in Hartford just a few years ago. We wish Andrew the best of luck with his new endeavor!

The Specter Menace

Arlen Specter wants the FISA court to oversee NSA intercepts of enemy communications. I have one question: Why? Why should these judges decide which enemy communications should or should not be intercepted? The Constitution grants the president commander-in-chief power — not the judiciary, and not Congress. Congress can defund the program. But that’s all Congress can do. The judiciary has no explicit power over war-making decisions. And past courts have recognized as much.

Those who demand expanded power for the judiciary over the executive claim to be concerned about executive abuse. But where is this executive abuse? And what of judicial abuse? Throughout the Roberts and Alito hearings, Specter complained about the Court second-guessing Congress’s legislative will. Yet he encourages judges doing exactly the same thing respecting the president’s war-making decisions.

Specter is a stubborn man unencumbered with a fundamental understanding of the Constitution. He has also become a menace whose contribution to the war effort has been to torment the administration with press releases, media appearances, and letters to top officials demanding that they cease trying to win this war. When will the Republican caucus replace him as Senate Judiciary Committee chairman with someone who has better judgment, a better grasp of the law, and a better understanding of the president’s duties?

What’s the difference between investigating the source of information that appeared in a Bob Novak column and information that appears in a New York Times article? Novak was forced to appear before a federal grand jury and reveal his source for Valerie Plame’s employment. And as the investigation ensued, numerous other reporters were forced to spill the beans on their sources. This investigation was initiated with the full support of the media and congressional liberals. In fact, they were so concerned that the investigation proceed aggressively that they insisted on the appointment of a special counsel. And after Patrick Fitzgerald was appointed, for weeks they built him up as if he were Eliot Ness.

I am getting a bad feeling about the outcome of the Hamdan decision relating to military commissions, which is about to be handed down by the Supreme Court. I hope I am wrong, but I fear since its 2004 Rasul and Hamdi decisions — granting unlawful enemy combatants detained at Guantanamo Bay the right to file habeas corpus petitions in civilian courts — the justices no longer feel limited by the Constitution or precedent and will intervene further in the executive’s war-related policies. If so, it was predictable. See here.

I would ask David Kay, and all others invested in the no-WMD-in-Iraq mantra, why Negroponte, et al, fought so hard against releasing this information if it’s inconsequential? And why they continue to fight against releasing the rest of the document’s information (minus the usual sources and methods stuff)?

Some of us also served in top government positions and are quite familiar with requirements surrounding the classification and release of information. To first oppose, and then drag out the release of this information, and then claim that it’s worthless, makes no sense.

Liberal New Republic writer Jonathan Chait writes in today’s Los Angeles Times that “In addition to shepherding campaign finance reform through Congress — against the administration’s efforts to kill it quietly — [John McCain] co-sponsored a patients’ bill of rights with John Edwards (D-N.C.) and Ted Kennedy (D-Mass.); co-sponsored with Charles Schumer (D-N.Y.) a measure to allow the importation of generic prescription drugs; co-sponsored with John Kerry legislation to raise auto emissions standards; and co-sponsored legislation with Joe Lieberman (D-Conn.) to close the “gun-show loophole” and reduce greenhouse gas emissions in compliance with the Kyoto accords. On all these things he sided with Democrats against the White House and virtually every Republican.”

And, of course, McCain has teamed with Kennedy—again—to grant amnesty to illegal aliens and is another voice calling for Secretary Rumsfeld’s resignation.

Instead of Murtha on Sunday morning TV…

Everyday, all across America during World War II, stories about the war made the front pages of our newspapers. Ask anyone from that generation and they’d tell you there were no leaks to the press about things like when a convoy was getting under way, the methods used to track down saboteurs here, or the progress of development of the B-29 bomber. Instead, they read of national and hometown heroes. In 1944, somewhere in America, they probably would have read about this troop and thanked God for him and so many like him:

Later in the day, after he was transported by air to the 10th Combat Support Hospital in Baghdad, Lt. Col. James Love, commander, 1-10 Cav, Capt. Jon Bodenhamer, commander, Troop A, and members of his platoon visited Caldwell following surgery. Though groggy from the anesthesia, like all good scouts, he remained alert.

Zarqawi is dead. Hundreds of terrorists have been captured or killed in recent days. And now a document that purports to show the enemy weakened, demoralized, and linked to Hussein’s thugs. Has a major political party ever been so wrong about so much? I can see it now — Howard Dean, Harry Reid, and Nancy Pelosi huddled together in some Capitol Hill office trying to figure out how to turn good news into bad news and progress into defeat.

And to think that just last week, Pelosi had all but ordered a new name-plate for the Speaker’s door. If the president will stop promoting open-borders, he may yet turn the GOP’s political fortunes around. I’m betting he can.

The House leadership (both parties) has been rightly ridiculed for its ridiculous argument that the speech-or-debate clause of the Constitution confers protections on a member of Congress that the Framers never contemplated, i.e., virtual immunity from the search or seizure of potentially incriminating criminal evidence from their offices. Yet, no such ridicule has been unleashed on the preposterous legal arguments made by self-identified human-rights groups, left-wing defense lawyers, anti-Bush editorial boards, and certain members of Congress who claim that the Geneva Conventions do or should apply to unlawful enemy combatants – a.k.a terrorists.

It was reported that after the air strike, Zarqawi was still alive. Upon seeing US soldiers, he tried to speak before he died.

“He mumbled something, but it was indistinguishable and it was very short,” Maj. Gen. William Caldwell, spokesman for U.S.-led forces in Iraq, said Friday of the Jordanian-born terrorist’s last words.

Over and over again we’re hearing war critics in the media today comment that Zarqawi’s death is not the end of the war in Iraq, that the enemy has many heads, and that we will be in Iraq for some time. This is interesting. That’s what we hawks have been saying all along. That’s why we’ve been saying that we must not only stay the course, but ramp up our efforts to defeat this enemy. It’s the doves who’ve been talking about “redeployment” and turning tail. But the doves are trying to denigrate today’s accomplishment, i.e., the killing of al-Qaeda’s top commander in Iraq, with a constant drumbeat of defeatism. They believe the war cannot be won. Amnestyville Horror II

Most Americans are four square against the senate version of the 1986 classic “Amnestyville Horror”. The sense that most Americans have of right and wrong prevents them from forgiving the felonies committed by the illegals and their employers.
They simply see it as a right and wrong issue and the senate is on the wrong side of it.
While I agree with those sentiments I also believe there is something more insidious about the plan than a simple right and wrong issue.

Let’s set aside the forgiveness of numerous felonies committed by illeagals and their employers, likewise the two years of tax free living, all other benefits that will be bestowed upon the felons and the additional hundreds of millions of immigrants that will be allowed to enter the U.S., and concentrate on the what makes this plan the absolute undoing of the United States.

This Matter of Marriage

An amendment to the Constitution defining marriage will be introduced in the Senate today. Its opponents are already disparaging the effort as an election-year ploy to fire-up the conservative base. Others have gone further, claiming it’s discriminatory and even hateful.

Let’s take a step back. Who started this battle? The so-called gay-rights groups, who developed a litigation strategy of cherry-picking states where they thought activist judges would impose their definition of marriage on the public. And they succeeded in Massachusetts. They have also made significant progress in the all important U.S. Supreme Court. In 1996, in Romer v. Evans, the Court upheld a permanent injunction against a successful statewide constitutional referendum in Colorado barring the inclusion of “sexual orientation” in civil rights laws that ban racial and religious discrimination. In 2003, in Lawrence v. Texas, the Supreme Court went even further. It ruled that homosexual sex (in this case sodomy) is protected under the Fourteenth Amendment. This is clearly the precedent the Court will rely on to strike state marriage laws that define marriage as the joining of a man and a woman.

Eddie Ryan Fundraiser

On Saturday, June 3 the American Legion Post 488 in Monroe, Orange County will be hosting a fundraiser for Sgt Eddie Ryan. As you know, he was severely injured in Iraq after being shot twice in the head. All the odds said he would not make it, but his strength, determination, and prayers got him through. But he is not out of the woods; he needs to have his home in Ellenville rehabbed to be wheelchair accessible. The VA has monies placed aside for him but they are slow to put out. A grassroots effort by his community has raised about half the money, but the total is close to $100,000.00. Help Bring Eddie Ryan Home is a combined force fundraiser mentioned above, which includes an all day BBQ, Beer Wine and Soda, a DJ, Bagpipes, and the USMC Band.

Cost: $25.00 per person
Children under 12 free.

Raffles will be held including gift certificates, and prizes.

Please, if you live in the area, make the trip. I can’t think of a better way to say “thank you” to this young man than to turn out and show him our support.
