Tortured Debate, Tortured Timing
What and why?As I try to digest the debate over torture — or is it aggressive interrogation? (not sure, as the terms are not being defined) — I gather that it is sometimes understandable (or is it acceptable?), but not necessarily moral, to torture a potentially culpable detainee who might have information that could save a U.S. city. It is never moral — almost never understandable (or is it never acceptable?) — to torture (or is it aggressively interrogate?) an innocent person who might possess information that could save a U.S. city (although, if one possesses such information, and refuses to divulge it voluntarily, then is one truly innocent?).

Okay… finally a pro-democracy, pro-US involvement feature film about Iraq. I’m placing a bet right now this movie will go through the roof, to the consternation of many of Willis’ peers. Of course, that’s a risky prediction in the movie and political worlds, but considering the following from [yesterday’s] Washington Post (via Balloon Juice), I feel pretty secure about this one:
Seventy percent of people surveyed said that criticism of the war by Democratic senators hurts troop morale — with 44 percent saying morale is hurt “a lot,” according to a poll taken by RT Strategies. Even self-identified Democrats agree: 55 percent believe criticism hurts morale, while 21 percent say it helps morale.
That’s a lot of people who want to stand up and cheer for our troops.

Then Sean mentioned it and linked from his site late Friday, Powerline Blog gave us a plug Sat AM, and Cliff May posted a note on the Corner yesterday afternoon. Now we’re at 10,000 signatures.

In 2004, the family of a soldier who was killed in the war in Iraq sent a photo to a member of 9/11 Families for a Safe & Strong America. According to the latter:
“You see a Marine in profile, that was taken in soon after our invasion and was on the front page of every newspaper in the country. It was on the wall of the military headquarters in An Nasiriyah. That was Thomas Slocum’s unit. I sent that picture to his mother and step father, Terry and Stan Cooper, and they immediately recognized their son’s unit, telling me it was taken by a photographer embedded with them. They recognized the photo. Nine Marines were killed in one action. The enemy pretended to surrender, then open fired with an RPG attack.” She added this question, “These are the people who should have lawyers and due process?”

Chris Smith of New Jersey and the New Jersey Republican Senate primary campaign of Jeffrey Bell, an early adviser to former California Gov. Ronald Reagan?
What if, in addition to all this, the applicant stated he was a member of the conservative Concerned Alumni of Princeton and the Federalist Society, and regularly attended the latter’s Washington, D.C., luncheon meetings?
In 1985, then-Associate Deputy Atty. Gen. Mark R. Levin (who is now president of Landmark Legal Foundation, an occasional contributor to HUMAN EVENTS and author of the New York Times bestseller Men in Black–How the Supreme Court is Destroying America, published by Regnery), forwarded the application of just such a person to the Reagan White House personnel office.

Bill Tierney is a former military intelligence officer and Arabic speaker who worked at Guantanamo Bay in 2002 and as a counter-infiltration operator in Baghdad in 2004. He was also an inspector (1996-1998) for the United Nations Special Commission (UNSCOM) for overseeing the elimination of weapons of mass destruction and ballistic missiles in Iraq.

It might upset Andrew Sullivan and others to learn that at one point during WWII, there were 11 million German POWs, and not one of them had access to a federal court. Today, even unlawful enemy combatants, aka terrorists, have access to federal courts and a laundry list of due process claims. Monday, for the first time, the foul odor of the Vietnam War denouement wafted through the Senate chamber during the debate on Iraq. The Democrats called for “estimated dates for the phased redeployment of United States Armed Forces from Iraq.” Phased redeployment was the maneuver the French executed in June 1940 in the days preceding the German occupation of Paris. Phased redeployment is what the Vietnamese boat people did as they swam for their lives away from their homeland.

In the past, our good buddy F. Lee has taken the time on his show to point out the heroic actions of America’s warriors during times of war. While on my honeymoon in Hawaii, I decided that I would pick out a fallen soldier, visit his grave at the Punchbowl (National Memorial Cemetery of the Pacific), and tell his story when I got back.
When I walked into the visitor area of the Punchbowl, I noticed the pictures of 30 soldiers who were awarded the Medal of Honor and whose bodies rested there. It was there that I decided that I would visit the grave of Marine Corporal Larry Leonard Maxam. Maxam’s actions on the day of Feb. 2, 1968 showed incredible bravery and a great sense of devotion to his fellow marines. Maxam was just 20 years old when he lost his life that day in Vietnam. What follows is the official record of his actions.
Citation:
For conspicuous gallantry and intrepidity at the risk of his life above and beyond the call of duty while serving as a fire team leader with Company D. The Cam Lo District Headquarters came under extremely heavy rocket, artillery, mortar, and recoilless rifle fire from a numerically superior enemy force, destroying a portion of the defensive perimeter. Cpl. Maxam, observing the enemy massing for an assault into the compound across the remaining defensive wire, instructed his assistant fire team leader to take charge of the fire team, and unhesitatingly proceeded to the weakened section of the perimeter.
Completely exposed to the concentrated enemy fire, he sustained multiple fragmentation wounds from exploding grenades as he ran to an abandoned machine gun position. Reaching the emplacement, he grasped the machine gun and commenced to deliver effective fire on the advancing enemy. As the enemy directed maximum firepower against the determined Marine, Cpl. Maxam’s position received a direct hit from a rocket-propelled grenade, knocking him backwards and inflicting severe fragmentation wounds to his face and right eye. Although momentarily stunned and in intense pain, Cpl. Maxam courageously resumed his firing position and subsequently was struck again by small-arms fire.
With resolute determination, he gallantly continued to deliver intense machine gun fire, causing the enemy to retreat through the defensive wire to positions of cover. In a desperate attempt to silence his weapon, the North Vietnamese threw hand grenades and directed recoilless rifle fire against him, inflicting two additional wounds. Too weak to reload his machinegun, Cpl. Maxam fell to a prone position and valiantly continued to deliver effective fire with his rifle.
After 1 & 1/2 hours, during which he was hit repeatedly by fragments from exploding grenades and concentrated small-arms fire, he succumbed to his wounds, having successfully defended nearly half of the perimeter single-handedly. Cpl. Maxam’s aggressive fighting spirit, inspiring valor and selfless devotion to duty reflected great credit upon himself and the Marine Corps and upheld the highest traditions of the U.S. Naval Service. He gallantly gave his life for his country.

It’s hard not to be moved by the selfless actions of this brave Marine. Corporal Larry Leonard Maxam was the embodiment of Semper Fidelis and a hero. If you ever go to the island of Oahu in Hawaii, take the time to visit the Punchbowl. There you will find Corporal Larry Leonard Maxam and many other brave American heroes who rest there with him, including some of those who lost their lives on the USS Arizona. These men make me proud to be an American.

UNDUE PROCESS [Mark R. Levin]
I am fascinated that those advocating due process rights (even U.S. constitutional rights) for the enemy, beyond those conferred on the Nazis or Communists, and beyond those compelled by existing domestic and international law, are viewed as the humanitarians in this debate. Torture is already illegal. In fact, mistreatment that falls below the torture threshhold — case in point, Abu Ghraib — violates military policy and is prosecuted. I am not aware that our government is employing torture against the enemy as a matter of policy. However, I am aware that certain foreign governments, self-appointed human-rights organizations and politicians have made the claim to advance their opposition to the war. I am also aware that the al-Qaeda handbook directs detainees to claim torture regardless of the nature of their treatment. We ought not set national security policy based, even in part, on these considerations.

That news led to a criminal investigation of Limbaugh by Palm Beach County State Attorney Barry Krischer, who in December 2003 leaked to the media that his office had uncovered evidence of 10 felony counts, including “doctor shopping,” money laundering and drug trafficking. Despite the sensational allegations, no charges have been brought.
Worse, in the latest round between the State Attorney’s office and Limbaugh, Assistant State Attorney James Martz made a startling admission in open court on Tuesday as he sought a court order allowing his office to interview Rush’s doctors.

“No fundamental right of parents… no due process or privacy right…” It’s right there, in black and white. Parents now officially have no right to protest what public schools tell their children.

Slouching Toward Pampering the Enemy
Military tribunals are nothing new.I would not have thought that four short years after 9/11, two branches of the federal government would be taking what are historically extraordinary measures to grant unprecedented due-process rights to unlawful enemy combatants held overseas. In 1950, in Johnson v. Eisentrager, the Supreme Court held it did not have the authority to take up a challenge by 21 German nationals held in China, who were tried and convicted by U.S. military tribunals. In 2004, in Rasul v. Bush, the Court reversed course and held that U.S. civilian courts would be open to foreign enemy combatants held overseas. I strongly criticized that decision at the time. And next March, the Court will decide whether the president has the authority to set up military tribunals in a case involving Salim Ahmed Hamdan, an al Qaeda member close to Osama bin Laden. Military tribunals have a long tradition in this country.

Questions Raised about Tim Russert’s StoryNBC Washington bureau chief Tim Russert told Leakgate probers that he had no idea Joe Wilson’s wife Valerie Plame was a CIA employee before her name surfaced in Robert Novak’s fateful July 14, 2003 column, and that he was stunned upon learning that Lewis “Scooter” Libby claimed he got that information from him.
But an account by senior NBC correspondent Andrea Mitchell raises questions about whether Mr. Russert may have known about Plame’s employment well before the Novak column.
On Oct. 3, 2003, Mitchell was a guest on CNBC’s now-defunct “Capital Report,” where she was asked by host Alan Murray:
“Do we have any idea how widely known it was in Washington that Joe Wilson’s wife worked for the CIA?”
Mitchell replied: “It was widely known among those of us who cover the intelligence community and who were actively engaged in trying to track down who among the foreign service community was the envoy to Niger. So a number of us began to pick up on that.”
Mitchell’s “widely known” characterization flatly contradicts assertions last Friday by Leakgate Special Counsel Patrick Fitzgerald, who repeatedly insisted that Plame’s association with the CIA “was not widely known.”
But perhaps more importantly, if Plame’s work was an open secret in media circles [according to Mitchell], how is it that her boss, Mr. Russert, who - as NBC Washington bureau chief was presumably monitoring developments in “the intelligence community” as they related to the Wilson story - would have been oblivious to this same “widely known” information?

Yes, you must have heard by now that Clinton told a great big whopper at the Rosa Parks memorial the other day. Nothing new there. Same old Clinton. However, Mark discussed why the premise of his false comments is particularly disturbing.

Hypocrisy is on show in a Manhattan courtroom today. The New York Civil Liberties Union will argue for the second day before Judge Richard Berman that the city’s subway bag search policy is an “unjustifiable erosion of the privacy rights of the American public.” Yet take a walk into the NYCLU’s Manhattan headquarters - which it shares with other organizations - and you’ll find a sign warning visitors that all bags are subject to search.
I love the smell of hypocrites in the morning.

Tuesday, October 25, 2005; A21The Judith Miller-Valerie Plame-Scooter Libby imbroglio is being reduced to a simple narrative about the origins of the Iraq war. Miller, the story goes, was an anti-Saddam Hussein, weapons-of-mass-destruction-hunting zealot and was either an eager participant or an unwitting dupe in a campaign by Bush administration officials and Iraqi exiles to justify the invasion. The New York Times now characterizes the affair as “just one skirmish in the continuing battle over the Bush administration’s justification for the war in Iraq.” Miller may be “best known for her role in a series of Times articles in 2002 and 2003 that strongly suggested Saddam Hussein already had or was acquiring an arsenal of weapons of mass destruction.” According to the Times’s critique, she credulously reported information passed on by “a circle of Iraqi informants, defectors and exiles bent on ‘regime change’ in Iraq,” which was then “eagerly confirmed by United States officials convinced of the need to intervene in Iraq.” Many critics outside the Times suggest that Miller’s eagerness to publish the Bush administration’s line was the primary reason Americans went to war. The Times itself is edging closer to this version of events.
There is a big problem with this simple narrative. It is that the Times, along with The Post and other news organizations, ran many alarming stories about Iraq’s weapons programs before the election of George W. Bush. A quick search through the Times archives before 2001 produces such headlines as “Iraq Has Network of Outside Help on Arms, Experts Say”(November 1998), “U.S. Says Iraq Aided Production of Chemical Weapons in Sudan”(August 1998), “Iraq Suspected of Secret Germ War Effort” (February 2000), “Signs of Iraqi Arms Buildup Bedevil U.S. Administration” (February 2000), “Flight Tests Show Iraq Has Resumed a Missile Program” (July 2000). (A somewhat shorter list can be compiled from The Post’s archives, including a September 1998 headline: “Iraqi Work Toward A-Bomb Reported.”) The Times stories were written by Barbara Crossette, Tim Weiner and Steven Lee Myers; Miller shared a byline on one.

Rockefeller memoHere is the full text of the memo from the office of Sen. Jay Rockefeller (D-WVa.) on setting a strategy for pursuing an independent investigation of pre-war White House intelligence dealings on Iraq.
We have carefully reviewed our options under the rules and believe we have identified the best approach. Our plan is as follows:
1) Pull the majority along as far as we can on issues that may lead to major new disclosures regarding improper or questionable conduct by administration officials. We are having some success in that regard.
For example, in addition to the President’s State of the Union speech, the chairman [Sen. Pat Roberts] has agreed to look at the activities of the office of the Secretary of Defense, Rumsfeld, Wolfowitz, as well as Secretary Bolton’s office at the State Department.
The fact that the chairman supports our investigations into these offices and cosigns our requests for information is helpful and potentially crucial. We don’t know what we will find but our prospects for getting the access we seek is far greater when we have the backing of the majority. [We can verbally mention some of the intriguing leads we are pursuing.]

Associated Press WriterORFORD, N.H. The one-room cabin David Bischoff built in a cow pasture three years ago has no electricity, no running water, no phone service and no driveway. What it does have is a wide-open view of nearby hills and distant mountains _ which makes it seven times more valuable than if it had no view, according to the latest townwide property assessment. He expects his property taxes to shoot up accordingly.
Bischoff and other Orford residents bitterly call that a “view tax,” and they are leading a revolt against it that has gained support in many rural towns in New Hampshire. (more…)
