The Supreme Court of late has been hijacked by those imposing their will on the people instead of deciding the matters before them by interrupting the law. The recent decisions of ‘Eminent Domain, giving due process rights for foreign combatants, as well as the recent Supreme Court decisions upholding affirmative action and striking down sodomy laws brought a renewed focus to our nation’s top court. It is in my opinion that the Supreme Court has not drifted from the original intent of the founders; it has become a category five hurricane blowing in from the left.
With the passing of Chief Justice William Rehnquist on September 3rd, and the retirement of Sandra Day O’Connor, there now stand two vacancies on the nine member Supreme Court.
Judge John C. Roberts will have his hearings begin this Tuesday. He was nominated following the O’Connor retirement.

Who do you think President Bush will nominate to the Supreme Court to replace William Rehnquist;
Robert H. Bork: 78, is a conservative legal scholar and former judge who advocates the judicial philosophy of ‘Originalism’. Bork is a former Solicitor General and in 1987 he was was nominated for the position of Associate Justice on the Supreme Court by President Ronald Reagan however his nomination was rejected by the Senate in a 58-42 vote.
Janice Rogers Brown: 56, was confirmed this June to the U.S. Court of Appeals for the D.C. Circuit. For nine years before that, she was a California Supreme Court justice.
Edith Brown Clement: 57, is a judge on the New Orleans-based U.S. Court of Appeals for the 5th Circuit. Clement was nominated by President George H.W. Bush to serve as a judge on the U.S. District Court for the Eastern District of Louisiana in 1991 and was elevated to her current post by the current President Bush in 2001.
Sen. John Cornyn: 53, is the junior senator from Texas, elected in 2002
J. Michael Luttig: 51, has been a favorite in conservative legal circles for decades, going back to his clerkship for then-Judge Antonin Scalia on the U.S. Court of Appeals for the D.C. Circuit in 1982-83.
Theodore B. Olson: 64, is the former Solicitor General and now an attorney in private practice in Washington at the firm Gibson, Dunn & Crutcher. He argued Bush’s case before the Supreme Court that decided the outcome of the disputed 2000 presidential election.
Larry D. Thompson: 59, is a senior vice president and general counsel for PepsiCo. He was the deputy Attorney General–the No. 2 person at the Justice Department–for much of President Bush’s first term He was one of the highest-ranking African Americans in the Bush administration and if appointed to the court, would be the third African American justice. Thompson is a longtime acquaintance of Justice Thomas and was a member of the legal team that assisted Thomas during his confirmation hearings in 1991.
Emilio M. Garza: 57, is a judge for U.S. Court of Appeals for the 5th Circuit and has been on the short list for a Supreme Court nomination before. Garza, who will turn 58 in August, would make history as the first Hispanic ever nominated to the high court.
Alberto R. Gonzales: 49, as Attorney General he has less time on the bench than the other likely Supreme Court candidates but has one crucial advantage: the close friendship of President Bush.
J. Harvie Wilkinson: 61, was appointed to the 4th Circuit by President Reagan in 1984. Before his appointment he was the No. 2 official in the Justice Department’s Civil Rights Office from 1982-1983

I am confident Anton Scalia will be Chief Justice
I am looking at Janice Rogers Brown as the ninth jurist.
(I hope it is NOT Alberto R. Gonzales)
Don, this post really gives us something to think about.
I have heard reports that Bush will name John Roberts to be Chief Justice. The reason being, that if Bush should name Anton Scalia, he will have to go thru another Senate hearing. To avoid a second Sentate hearing, he would just replace Rehnquist with Roberts, since Roberts hearing is on the way.
Other reports I am hearing, is that he will replace Sandra Day O’connor’s seat, with Edith Brown Clement, of New Orleans. One reason being, he would want to honor the people of New Orleans, by appointing one of their own, and secondly, making Laura Bush very happy, by putting another female justice on the court.
But I have learned, not to second guess, what President Bush does. Let alone, not even try to guess what he’s going to do, because Bush has always surprised us in the past.
So, I’m going to sit back, and watch. I have faith, that our president is going to do the right thing.

My first reaction to the excellent question that Don posed is to say BORK ‘EM!!! BORK ‘EM ALL!!!
But then again, I have been known to cut off my nose to spite my face from time to time.
Actually, Bork would be an excellent choice but I think that we have to take his age into account. After all, these are lifetime appointments that we are talking about. We would be remiss if we weren’t to consider his age.
Frankly, I’m solidly with Ann Coulter on her position on the nominees to the SCOTUS. We need to know that the nominees, who ever they may be, are rock solid conservative. The libs are going to call anyone right of Teddy Kennedy “an extremist” anyway, so what the hell, go for broke! Lets not take a chance on another Souter!
During the hearings and before the votes are tallied, we need to mobilize as we did when W was running for re-election. We must call these linguine spined polititions and demand that they fight for the Presidents nominee.
As Mark has told us, Supreme Court Justices do not have to be Lawyers. This should also be taken into consideration.
But if I have to pick from the list presented, I love you Bob Bork but I’d have to go with Luttig. And his old boss for Chief Justice.

If I was a betting man, I now think that ‘W’ will go with J. Michael Luttig. It will throw the libs off guard who are begging for a woman to replace O’Connor, and would please Antonin Scalia.
