Monday, Mark put his differences aside and gave Michael “Savage” Weiner some advice in his lawsuit against CAIR.
You need to amend your complaint. You need to include tortious interference with contract. Because the reason CAIR is going after you and your advertisers is to get you fired. It’s basically to starve your program of any revenue.

So, go ahead and amend your complaint. Add tortious interference with contract. That copyright count is pretty thin. And believe me, that one will withstand scrutiny by any judge for any challenge by these nutjobs.

Ya gotta love Mark. He believes Savage is a “putz”, yet he still gives him some sage advice about how to improve the chances of winning his lawsuit against C.A.I.R. I think that’s really very decent of him. In any case, it’s C.A.I.R. that is the real enemy. I’m glad Mark did this.

Ambivalent feelings about this. REAL ambivalent. I accept it with all the ease of drinking a gallon of 20-year-old vinegar.
Weiner doesn’t even deserve the attention. He’s C.A.I.R.’s best friend, as far as I’m concerned.

Are there any lawsuits currently pending, aimed at THOSE who consistently blaspheme Christianity, and Judaism, through film (yes, that den of iniquity, Godless HOLLYWOOD), arts, journalism, etc? If not, WHY NOT!
Take on CAIR, In court, they will be forced to disclose their financial sponsors. I am sure they don’t want to do that, do they?
As to Mark offering legal advice to a “foe”, here are two reasons:
>> don’t be fooled – Mark Levin, despite his aggressive attorney style of delivery, the man has a heart of gold (doesn’t take Einstein to find that out);
>> Levin sees things in context – the bigger enemy is CAIR!
ScottT says Weiner is CAIR’s best friend. Has there been a fallout? Why is CAIR suing its bosom buddy?
Levin sees what is at stake. He is above the rivalry with Weiner. CAIR is a far more formidable enemy in the grand scheme of things.

Once again the Great One proves he is an all around mensch. But the only warming up to a weiner Mark is going to do is on the grill…with ketchup.
Sounds to me like a straightforward libel/slander lawsuit. If they misrepresented and distorted the true meaning of what he said; if they did that deliberately; if they knew this “repackaged†misleading material would cause financial damages the thresholds for substantiating the complaint have been met. They will counter with the argument that what they said and published was truthful and accurate and as such is an absolute defense. Maybe it was but the statements were out of context and they rebuilt that context in a fashion that clearly was designed to create a different meaning and financial damage. If in the context of what he said the meaning is totally different than what CAIR implied they have a problem because those advertisers have left on the basis of what they stated that Savage said and not actually on what Savage really said. Moreover that financial damage was designed to get him off the air and that is where the “tortuous interference†becomes very relevant. It is a little bit like gun rights. There is a certain amount of control and oversight that can be expected from the government but you cannot absolutely ban gun ownership. They are not content with him losing a few advertisers and experiencing some financial discomfort. They want him off the air. That terminates his livelihood.
But this can be a very big problem for CAIR. They can be deposed and if this were a Federal prosecution, which it is not, they would have certain rights relative to self-incrimination. Savage, as a private citizen, in some respects, can go where the Feds cannot. That said Savage can start discovery into proving that the organization has terrorist ties and is therefore not only a criminal organization but is not deserving of the coveted 501C tax exception. If he proves that they lose the exception but they may also be in criminal violation of the IRS code. Depends on how the IRS looks at it. More than that if he connects the dots and they are proven to have terrorist ties they face all sorts of Federal Statute violations. Even though this is a civil lawsuit that info can be given to the State Attorney, The Attorney General, a District Attorney and the FBI. If I were CAIR, based upon the aforementioned, I would be thinking of a way out of the lawsuit and not a way through it.
Of course Savage needs a major modification that goes way beyond the weak claim of copyright infringement that, even if proven, may just result in a fine.
ML does this because he knows that this is about talk radio and in that sense he is handcuffed to Savage. Sometimes to save yourself you need to save the jerk next to you.

Yeah, of course I know that C.A.I.R. is the bigger evil than Weiner. My point in calling that piece of sh*t C.A.I.R.’s “best friend” is that he spews vile, anti-foreign policy tripe that emboldons the very creeps (like C.A.I.R.) who’d like us all dead. Weiner is every bit as bad as the likes of Durbin & Kucinich when it comes to trashing his own executive branch when they’re in the middle of a war. The creep says we invaded Iraq “for oil”. Says Cheney “gives him the creeps” because Haliburton is “profiting” off the war. Called Rumsfeld a “murderer”.
Then he screams he’s a “real conservative” who “supports the troops”.
I have no doubt in my mind that more than a few of those troops he claims to “support” have been killed on the battlefield because of what that scum has said on the air.
Don’t ask me to retract that last statement, either. I stand by every word of it.
THAT is why I said what I said. He speaks the language of the “Hate America” crowd with a megaphone while hiding behind a phony mantra.
And don’t kid yourself, HankWilliams4th…..Mark didn’t say what he said because he had “a heart of gold” (not for a sub-insect like Weiner, anyway; he reserves his “heart of gold” for those more deserving). No, he only did it because, as task said, the creep is in the same profession he is….and like it or not, he’s stuck with having to side with the gutter (Weiner) instead of the sewer (C.A.I.R.).
What sickens me is that of all the people who get defended in any kind of defamation case…..the LAST guy on earth who deserves “defending” is a puke like Weiner.
Savage often describes liberalism as a mental disorder. Oftentimes Weiner’s bifurcated stance on major issues, as helpful to the enemy as it is, leads me to believe that he also suffers from a mental disorder.
